1. Introduction

Welcome to the InstiKit School ERP mobile app (the "App"). This App is operated by InstiKit ("we", "our", or "us"). By downloading, accessing, or using the App, you agree to comply with and be bound by the following terms and conditions (the "Terms"). If you do not agree to these Terms, please do not use the App.

2. Use of the App

The App is intended for use solely by authorized users of schools utilizing the InstiKit School ERP system, including school staff, students, and parents.
You must provide accurate and complete information when using the App. You are responsible for maintaining the confidentiality of your account information and password.
Unauthorized use of the App is strictly prohibited. You agree not to use the App for any unlawful or prohibited activities.

3. Access and License

InstiKit provides a self-hosted license allowing clients to host the ERP solution on their servers and use the App through the API of their application.
This license is non-transferable and non-exclusive. You may not sublicense, transfer, or assign the license to any third party without our prior written consent.

4. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of InstiKit and are protected by intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material on our App without our prior written consent.

5. User Conduct

You agree not to misuse the App or interfere with its normal operation.
You must not attempt to gain unauthorized access to any part of the App, other accounts, or systems connected to the App.
School staff, students, and parents must use the App solely for its intended educational and administrative purposes.

6. Data Collection and Sharing

Schools using the InstiKit School ERP system may collect various types of student information, including but not limited to names, dates of birth, unique IDs, photos, and other records.
Schools may be required to share student data with government authorities as mandated by law. By using the App, you acknowledge and consent to such data collection and sharing practices.

7. Limitation of Liability

InstiKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

8. Modifications to the Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the App. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Chhattisgarh - India, without regard to its conflict of law principles.
